DETAILED TERMS AND CONDITIONS FOR THE V&S MOMFLUENCER SEARCH COMPETITION

The following terms and conditions apply to the V&S Momfluencer Search Competition, run by VIE SANTE PTY LTD, hereby known as the Promoter.

ELIGIBILITY:

• This promotion is open to South African citizens, residing at a South African address, who can provide a valid South African ID. Entrants must be 18 years or older.
• Employees of the Promoter and their immediate families, promotional partners, and advertising and promotional agencies are not eligible to participate.

PARTICIPATION AGREEMENT:

By entering this Competition, all participants acknowledge their legal capacity to enter, and agree to be bound by these terms and conditions. The Promoters’ decision regarding any dispute will be final and binding, and no correspondence will be entered into.

ENTRY TO THE COMPETITION:

To enter the Competition, Participants must follow the entry mechanics as set out in the Competition announcement post on Lisa Mthembu’s social media platforms.

By participating in the Competition in accordance with the entry mechanics, the Participants are agreeing to all the terms and conditions set forth here.

SELECTION OF WINNER:

The winner will be chosen by the Vie&Sante marketing team at their sole discretion. Their decision is final, and no negotiation will be entertained after the fact.

PRIZE:

• The prize is non-transferable and cannot be exchanged for cash.
• The prize will be awarded to the person who entered the competition and is able to present a valid South African ID.
• Each entrant is entitled to win only one prize within a period of three calendar months. The Promoter reserves the right to withhold a prize from a winner who has won a prize during this three-month period.
• Failure to claim the prize or refusal or inability to provide the required documentation within two months will result in disqualification of the winner, and a new winner will be drawn.
• Prizes may take up to 30 days to be delivered, and will be sent only to the winner.

AMBASSADOR RESPONSIBILITIES:

The winner will enter into a six-month ambassador agreement with the Promoter. As an ambassador, the winner agrees to socially post positive and authentic content promoting the Safari Squad range, in adherence to monthly post requirements set by the Promoter. The content creation responsibility lies entirely with the winner, and should be performed in a manner that preserves and promotes the reputation of the Vie&Sante brand and its products. The exact nature and obligations related to this content will be communicated in a separate agreement to be signed by the chosen ambassador.

The winner may be required to attend up to two promotional events during their six-month ambassador term. They will be notified in advance of these events and are expected to make time to attend, barring serious emergencies. The exact nature and obligations related to these events will be communicated separately.

DISCLAIMER:

Failure to meet the obligations outlined above may result in the termination of the ambassador agreement, at the Promoter’s sole discretion. Any such decision will be communicated by the Promoter in writing and is not subject to appeal.

PROMOTIONAL PARTNERS:

Sorbet Group and Oh Lief Natural Products are promotional partners for this Competition, and have generously provided hampers for the prize. However, they are in no way responsible for the conduct, administration, or outcome of the Competition. Any queries, comments, or complaints regarding the Competition should be directed solely to Vie Sante PTY LTD (the “Promoter”). No legal action may be taken against Sorbet Group or Oh Lief Natural Products in relation to this Competition.

DATA USE AND PRIVACY:

Information collected from Participants will only be used by Vie&Sante and will not in any way be transferred or made available to third parties.

GENERAL TERMS:

• The Promoter reserves the right to change the terms and conditions of the promotion, terminate the promotion at any time, and/or redistribute all unclaimed prizes.
• This promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, or WhatsApp.
• Participants grant the Promoter permission to use their images, stories, and names for promotional purposes.
• Participants warrant that they have full rights to any content uploaded for the competition and that their participation does not infringe on any third party’s rights.
• The Promoter reserves the right to disqualify any participant suspected of fraud, cheating, or breaching these terms and conditions.
• This promotion and its terms and conditions are governed by the law of the Republic of South Africa.
• To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the “Consumer Protection Act”), no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act.
